Local Man Re-Sentenced After Appealing to Higher Court

A man convicted of voluntary manslaughter five years ago and sent to prison for 15 years was re-sentenced on Wednesday to ten years, meaning that Shane Adam Burdette of Westminster will get out of prison sooner. Burdette admitted in court on Wednesday that a pellet from a shotgun caused the fatal blow to James Evan Tyner, which, Burdette said, was only meant to scare Tyner off his property and not intended to kill him. Now age 41, 10th Circuit Court Judge R. Scott Sprouse said he thinks Burdette will be young enough upon release to make something good from the rest of his life. The case was brought before Judge Sprouse after a successful appeal to a higher state court.
