Affidavits Seald in Prisma v UHC Case

This week, a judge issued an order in the case of Prisma Health versus United Healthcare, sealing the affidavits of two Prisma Health officers, Matthew Elsey and Malcolm Isley.

The hospital corporation and the health insurer are in disagreement over whether Prisma Health will continue to honor claims from patients insured by United Healthcare.

Judge Perry Gravely’s order states that the parties’ counsel should consult in good faith to reach an agreement on what portions of the affidavits can be redacted and filed in the public record. The order also states that based on the confidentiality provisions in the parties’ agreements, the parties have an expectation of confidentiality and may be harmed by the disclosure of confidential information.

The sealing of these records serves the public interest due to the impact of contract negotiations on public health.
